Your Rights to Reconstruction breast reconstruction

As a mastectomy patient, are there any measures in place that protect my rights to breast reconstruction?

Your right to breast reconstruction may be protected under the Federal Women's Health and Cancer Rights Act of 1998. The Women's Health and Cancer Rights Act (WHCRA) requires insurance companies that cover mastectomies to provide certain benefits related to reconstructive surgery and other post-mastectomy procedures. This can include coverage for reconstructive nipple surgery and surgeries that extend to the uninvolved breast to improve overall symmetry.

Your insurance provider is required to notify you regarding your rights as addressed by WHCRA at the time of enrollment. Please read through this information carefully. It is important to note that your healthcare provider may not pay for both a breast prosthesis and reconstructive surgery. This means that if you are reimbursed for a breast prosthesis, your insurance company may choose not to provide coverage for any subsequent breast reconstructive procedure.

Although WHCRA is a federal law, individual states have jurisdiction over whether WHCRA applies to individual insurance plans and group policies. If your state does not mandate reconstruction rights as set forth by WHCRA, contact your local representative to voice your support for increasing breast reconstruction awareness.
